Test and non-EPG channels

Okay, purley hypothetical scenario here:

Let say a new babe channel starts a test feed (only accessible if the user goes to the trouble of discovering its frequency and adding it using Sky's 'add channels' feature).

So one day, the technicians decide to test out the equipment and get one of their models to get on the bed while they check the camera focus, zooms, cuts, etc. Then let's suppose that for a bit of a laugh - and knowing they're not yet listed on Sky's EPG and that the broadcast can't be accessed by anyone who hasn't taken the trouble to input its frequency - the girl decides to strip off and give the crew a quick hardcore session.
Now let's futher imagine that someone decides to take offence (ignorng the fact he must've have 'added' the channel in the first place - I did say it was hypothetical) and contacts Ofcom to complain. This then raises the rather big question; where does this channel stand in the eyes of the law and Ofcom's own regulations (surley they don't have any in place for test channels).

And before this is dismissed as silly, let me tell you that I once checked on one of these babeshow test channels during the day, and they were showing a recording of the previous night's Sex Station.

No legal loop hole. They are broadcasting whether they are epg listed or not. Ofcom would apply rules as normal. Hardcore would certainly result in loss of license. The test channels are very actively monitored by the guys on the sat forums. Try:
