New Regulations

From midnight tonight the new Ofcom Teleshopping rules come into force. No longer will channels have to argue about whether a smiling babe is providing "editorial" content, or simply pushing a premium phone line. Provided the channels have re-registered, from midnight the babes will be officially allowed to advertise premium services.

This will be subnect to Section 22 of Advertising Code "rules governing the promotion of live PRS services, and rule 6.1 under which advertisements must not cause serious or widespread offence against generally accepted moral, social or cultural standards, or offend against public feeling."

Ofcom also says "The Advertising Code guidance draws attention to generally accepted standards for sex, nudity and offensive language. Ofcom has previously issued specific guidance to Adult Chat PTV broadcasters under the Broadcasting Code. Similar specific guidance for Adult Chat PTV may be appropriate under the Advertising Code." so they still have the Generally Accepted Standards (GAS) stick to beat channels with.

Also they warn that "Following introduction, the arrangements will be monitored carefully to ensure they provide the protection envisaged by Ofcom. Stakeholders should be aware that if they do not, or rules are not adhered to, then the rules may be subject to review and/or stricter conditions."

It is implied but not stated that adverts on encrypted channels can be stronger, or for stronger material, than on unencrypted channels, so an encrypted channel might be able to advertise sex shops, R18 DVDs and hardcore webstreams (but not actually show R18 content). In the past most channels have been caught out just for showing links to their own websites.

It would be nice to think this represents a new era in sensible censorship rules. After all the Advertising Code allows sexually explict adverts in the back of some magazines and papers. But in reality the boundaries probably won't move. The big difference is that Ofcom won't be able to say a pose is out of context. Also blatant advertising will be allowed, and that could result in new income streams.

I don't have much confidence that anything will change for the better. I wouldn't be surprised if the censorship becomes stronger to ensure that the rules are obeyed. Who cares about adverts, as the only racier ones will be on encrypted channels. If the adverts on the non encrypted shows CAN show full frontal nudity, then there's no reason why the live shows can't as well, since it's on the same screen. There would be no difference at all. Will keep my eyes peeled.

shouldn't make any difference to Cellcast , Cellcast have the Dutch licence , some one posted a link on this forum some months ago to a Ofcom bulletin were Ofcom them selves mentioned that the Cellcast shows that do not have the British licence will be unaffected by the new regulations has their powers are limited when channels do not have a British Licence , the only Cellcast show at that time that did not have a Dutch licence was the freeview Partyland show .

That's what I thought, but it seems that BSXTRA and Babestation still obide by Offcom's rules. There must be something else at play?

My guess is that even though registered in the underwater country, they reckon it would not be clever to rock the boat too much. It gets Ofsex off their backs, pushing it too far would result in Ofsex requesting an international banning order under EU rules.

After 2 nights of viewing I conclude that nothing has changed. The shows are no better or worse than was previous pre 1st September. As long as ofcom remain the shows will continue in the same trend.

With reference to the bath scene oh yes I saw it, one of the hottest shows bangbabes have put on for a while but somehow I think that was just coincidence as bangbabes had to up their game as the show was seriously on its knees and was probably more of a comercial decision rather than anything to do with new ofcom regulations as elite tv has been showing the same kind of shows pre 1st sep and after for a while now. But hopefully the shows will continue to improve and if it is the case that ofcom has relaxed the rules more then it is fantastic news as the fear of being hammered with fines could now be a thing of the past.

Seems to have got tamer over last 2 nights. Very poor output across the board.
