Mr Bluebird....if you are going to have a combined sub for HardBlue/R18 live web-stream , will there be a discount
for us "Freeview only" viewers , just for the web-stream. I am assuming that "HardBlue" is the encrypted channel
which will be on Sky only ?

Also , will Blubird give permission to any Sky subscriber to "HardBlue" to post any caps/vids on this forum for any
" Freeview only" viewer to enjoy ?

I don't know. People here used to complain about there being too many girls on the screen at one time.

Suspension of New Licences

Due to the implementation of The Audiovisual Media Services Directive (2010/13/EU) that will enter into force on 5th May 2010 Ofcom have suspended the granting of ALL new licenses until further notice.

The Audiovisual Media Services Directive is the European regulatory framework for television broadcasting, and replaces the Television Without Frontiers Directive (89/552/EEC, as amended by Directive 97/36/EC). Therefore, Ofcom must vary all television licences to reflect this, and is currently consulting with existing licensees on the relevant amendments.

This consultation will close on 20th May. I believe this consultation is to allow licensees to comment on the way Ofcom should (will, have) interpret(ed) the directive in relation to content, protection of children, product placement etc...

For any application for a TLCS licence (Linear TV Service) which are granted prior to 6th May, the new licensee will be invited to join the ongoing consultation (and will have a minimum of two weeks to make representations on the proposed licence variations).

However, in order to enable Ofcom to complete the consultation process and vary all licences appropriately, no new TLCS licences will be granted during a period commencing on 7 May and ending when all licences have been varied. They cannot state definitively when this moratorium on the granting of licences will end, but it is expected to be able to re-commence granting new TLCS licences in June, if all goes well and licensees agree to Ofcom's interpretation otherwise there may be greater delay, especially if a legal challenge is made due to Ofcom applying stricter rules than the directive requires.

Upon checking Ofcom's site as of 27th April there are no indications that Bluebird TV have taken over (transferred) any licenses for existing channels or applied for new licences.

Now whilst a lot can happen in 8 days if the posts are correct that at least Bob P has not, still under discussion, definately not for sale, sold his licence for 966 then will this impact on the full launch of Bluebird TV.

Now whilst the information does not talk about licence transfers to a new operator i would guess that Ofcom will be putting all their resources into getting existing licenses re-issued.

Current Ofcom rules state that existing licenses must be transferred before being utilised by a new operator. Such transfers not having effect until approved by Ofcom to ensure new licensees can comply with licence conditions, fit and proper test etc... This can be a lengthy process in itself.

I hope that Bluebird TV have all this in hand and are ahead of the process AND will challenge any interpretation of the new directive by Ofcom that imposes restrictions over and above what the directive requires. Thus allowing consenting adults to make an informed choice on their viewing pleasure especially when Ofcom state within their enforcement policy that they will take an arms length light touch approach to enforcement.

Fingers crossed and good luck for the future to Bluebird TV.
