Lets see what Ofcom are complaining about and how it relates to their research.
Time: Before watershed. Ofcom research says brief sex or nudity is acceptable at 9pm, does not apply here.
For content "Implying intercourse (where expected)" - the research panel felt this was Mild to Moderate.
Kissing with evident sexual overtones - panel felt this was "fairly mild"
Since there was no nudity "kissing with evident sexual overtones" would seem to be the nearest benchmark, and Ofcoms latest research fom May 2009 rated that "fairly mild".
I am not sure, but are music vids with shaking bums banned during the day?
Factors considered to make material less acceptable include time of broadcast in the crude sense of before or after the watershed, and how much after the watershed. For broadcasts before the watershed there is no automatic distinction between different times of day.
But likely audience is a factor. For example small children are more likely to be watching at 6pm than 8pm. The whole family is likely to be watching TV at 7:30-8:30am while eating breakfast.
But just because they are watching TV that does not make it "likely" that they will be watching ChatGirl TV. Ofcoms own research says small kids are unlikely to be watching. Older teens who deliberately seek out girlyshows might, but they are less likely to be harmed by it.
Ofcom quote the presenter offering to put on a pair of boots. Is that really shocking or offensive?
Is so when will they start taking action against daytime fashion shows?

That would be the same Playboy UK TV that notified ATVOD in June that it was relocating editorial responsibility to Canada, confirmed by Playboy in September. ATVOD decided they did not believe enough had been done and that Playboy UK TV should continue to be regulated as a UK based TV on demand provider. If they provide any R18 content without credit card verification (each time) they can be fined like Strictly Broadband was.
