As i have never watched any BSX shows i find it difficult to pass comment on them shutting down. Usually i go by the reviews people tend to post on the forum, and if you can tell it,s going to be a crap night simply by whose going to be on then you really are in trouble.

BSX wasn't shut down because of screencaps and it wasn't shut down because of the availability of screencaps either. The authorities would have come to their views on the channel by asking for recordings and then going through hours and hours of the supplied footage to verify that the material was too strong for the UK market.

So who are these authorities you are talking about that asked for recordings and went through hours and hours of footage to verify that the material was to strong for TV ?, Ofcom have stated the Dutch BS channels are out of their jurisdiction and remit, as Ofcom have said they pass on any complaints they may receive to NICAM to deal with, so are you saying the Dutch regulator is the one that's done this ?.
Any time Ofcom investigate and ask for recordings etc it has to be published in their broadcast bulletins, nothing has been mentioned about BSX in any Ofcom statements/bulletins .

{edit} People do realise that for the authorities to launch investigations, request recordings and then shut down channels etc, that it is a long processes involving Solicitors and channel representatives etc, every thing has to be transparent and made public when they do this, authorities that shut down channels have to make sure they do things in the correct way and do not breach any UK/European laws themselves by doing so. So if it was the authorities that shut down BSX with only a few hours notice as assumed by some people and not BSX themselves just axing the channel why was nothing published by any authority ? .

In that link that you posted yourself it states that "Ofcom has the power to act against UK-based broadcasters that offer R18 content or hardcore pornography." How would they know if a channel was dabbling in R18 content unless they went through channel output hour by hour to see for themselves what was being broadcast?

Ofcom say in that link they cannot ban or block hardcore pornography if the channel is regulated and licensed abroad even when shown on UK tv, they are talking about being able to act against Uk based broadcasters with a Ofcom licence and highlighting that they are powerless to ban or block Dutch based broadcasters that don't have a Ofcom licence.
The link i gave was about Ofcom complaining about the free to air Dutch licensed BS channels by the way were Ofcom say BS could be breaking UK laws (not their rules) by giving links to R18 websites free to air (it's allowed on encrypted channels)
UK laws do not allow R18 material to be shown on TV , NICAM have to bear in mind UK Laws when regulating broadcasts in the UK ,the broadcaster of BSX is Dutch and based in Holland, Game Networks BV is the channel owner/broadcaster of BSX not BS, and is regulated by NICAM not Ofcom, that's why Ocom say they do not have powers over them and do not deal with complaints' it's out of their jurisdiction/remit as stated by Ofcom (not me) .

I'm still not 100% convinced that's true!

I know it used to be banned in the Video Recordings Act of 1984, which was then later proved to be not worth the paper it was written on so it was rushed through parliament again.

However, whether to allow R18 broadcasting was definitely part of the pre-Ofcom consultation, so it was clearly an option at that point.

And the only current reference I can find about R18 broadcasting is within the Ofcom where it simply states "R18 may not be broadcast"

I am aware that there exist restirictions in British Law on the mail order of R18 DVDs (illegal) and the selling of R18 DVDs outside licensed sex shops (illegal), but obviously R18 magazines ARE legally available from any newsagent, and a few of the ones in my local newsagent have included free DVDs that genuinely were R18 (slipped through as foreign mag imports I believe).

But I haven't found any current law that prohibits R18 broadcasts, which are obviously not the same as R18 DVDs.

Confusing bloody country we live in - you can buy R18 mags anywhere, R18 DVDs only in licensed shops, and R18 TV not at all!

Is there any other product whose ownership is done in so many different ways?
