A good run? This is 2011. That attitude epitomises the white flag syndrome that Ofcon have, so successfully, cultivated.

How is it that our neighbours in Western Europe enjoy full-on Adult entertainment but, here in the U we canot watch it because we have an organisation like Ofcon telling us that it is harmful to kids!!!

I'm not angry anymore. Like nailpouchofmine, I've lost interest and wouldn't give two shiny shites if they all disappeared tomorrow. They're a complete bag of shite now and we wouldn't be losing anything of any value.

at no time broadcast sexually explicit language;

ensure any sexual language broadcast is restrained, and avoid its use altogether before midnight; and

ensure that where more than one presenter is in shot greater care is taken to avoid broadcasting the above images or language.


So there is not a total ban on 241's, the use of liquids is cautioned against but the babes can use restrained sexual language after midnight.

I do not know of any other specialist broadcasting sector being hounded to this extent.

Just to be clear, is this an actual quote from an Ofcom communication?

Interesting to see that the "gradual transition after the watershed" now lasts 3 hours instead of 2. When were we ever consulted over that?

I'm sure there are lots of people who feel the same as you, i.e. they will never call in, so why should the channels try anything new while they're still making money? Despite the doom mongering on here, I haven't really noticed any drop off in calls since the new rules were introduced. I honestly believe that a girl on screen is all you need, there will always be enough drunk/lonely/desperate people watching (and more importantly calling) to keep them in the black.

Thanks, didnt seriously doubt you but puzzled about where Ofcom had squirreled this away.

It can be found in an undated doc outlining its interpretation of BCAP advertising rules at Ofcom guidance on the advertising of telecommunications-based sexual entertainment services and PRS daytime chat services
"The first section quotes BCAP rules 4.1 and 4.2:
BCAP Section 4: Harm and offence Rule 4.1: Advertisements must contain nothing that could cause physical, mental, moral or social harm to persons under the age of 18. Rule 4.2: Advertisements must not cause serious or widespread offence against generally accepted moral, social or cultural standards."
The second section spells out what Ofcom thinks this means for FTA Babe channels.

Note that they say Rule 4.2 applies to encrypted channels - I was very clear that the consultation and move from Editorial to Teleshopping only applied to FTA channels.

Generally Acceptable Standards has been applied to encrypted channels by stealth. Before they could do anything except P18.

Note that the second section - the detailed list quoted above - is Ofcoms interpretation of the BCAP rules. I can understand that they might argue that Generally Accepted Standards are the same regardless of whether one is talking about drama or adverts, so the same research applies. And at a stretch I see that previous rulings for Editorial material therefore apply to Advertising and it is helpful to summarise these.

BUT they go beyond this.
No previous ruling has spelled out no bare breasts before 10pm. I WILL be complaining about Nivea adverts.
Previous rulings have NOT found spitting to be in breach. In has been mentioned in Descriptions, along with stockings and stillettos, not in Decisions.
The midnight ban on (non-explicit) sexual language is new. No previous ruling has been this clear, and 11pm has usually been regarded as the upper end of the watershed. Now we have a 3 hour transition.

Fact is this represents a tightening up (and clarification) of existing practice and procedure for both FTA and Encrypted material. The consultation gave no indication that this would be the case. It was not in the Impact Assessment. Every single Babe channel and every single viewer may have grounds for complaint on grounds of misleading action and financial loss (broadcasters only).

The doc can be found on the Ofcom website, but only with difficulty, by following these options:
Home > Stakeholders > Broadcasting > Broadcast Guidance > Program-related guidance
which yields a page with a link to "Ofcom guidance on the advertising of telecommunications-based sexual entertainment services and PRS daytime chat services" published 28/01/11.

Making information accessible is one of my biggest gripes about Ofcom.
If you were to ask for information to be given to you under the `freedom of information act`they still turn round and give `it is not in the public interest`.

Nearly everything they discuss,rules they make up etc.etc. is covered by this veil of secrecy,and it seems that the government let them get away with it.Doesn`t anyone think it is about time this stopped?

If they refuse to disclose information complain to the Information Commissioner. He has a good track record of slapping down self richeous organisations. And once slapped they stay down.
