To answer your question gunnar it's because Cellcast is based in the Neitherlands. 2 years ago Ofcom tried but failed in spectacular fashion when they tried to take Babestation out via nicam. Ofcom were left very red faced by the outcome and to note no further lobbying has taken place. The only time in the history that I can recall a babe channel leaving Ofcom high and dry.

I'm presuming that if Cellcast chose to end its license tenure in the uk with its remaining channels and then try to transfer them to Dutch control, that Ofcom may have a way stopping this??

Yes and no, but if such a transfer were made I'd imagine it wouldn't exactly be cheap to do. I think to be honest Babestation and the rest of the channels are currently holding their breath to see whoever replaces Ed Richards as the new Chief Executive of Ofcom isn't as big a cunt as he was to the channels before thinking of the potential loopholes such as more oversea's licences.
