They have been punished insofar as they were found in breach of Rule 1.18, 2.1 and 2.3 with a warning that further breaches may result in a statutory sanction. Whilst i don't want to be seen as bashing Elite but yet again they blamed an inexperienced producer for the breach who has subsequently been dismissed to mitigate the penalty. Defend your actions ffs and stop capitulating. Now Ofcom did not use rule 1.3 Children must be protected from unsuitable material by appropriate scheduling due to the time of the broadcast but went instead for protection of the under 18. Ofcom notes, however, that a broadcaster‟s right to freedom of expression, although applicable to sexual content and pornography, is more restricted in this context compared to, for example, political speech, and this right can be legitimately restricted if it is for the protection of the public, including the protection of those under 18. These night shows are at most rated 15 even with the offensive language, so a bit of a strange call from Ofcom when you consider that persons of 16 can legitimately; Get married, Have sex, Consume alcohol in a licensed premises, Join the armed forces etc etc.... So who are they actually protecting from broadcasts of this nature, at this time of night on a channel within the adult section. If these are repeat complainants then Ofcom have a duty to inform them of the electronic means that viewers can use to remove these shows from their EPG. Further complaints should then be dismissed without further consideration. RE: Serious warning for Elite TV - polo249 - 08-11-2010 22:28 well i feel like im damaged for life now i heard 2 chicks swear....what a fucking joke, get over yourselfs ofcom!!! RE: Serious warning for Elite TV - simplymarko - 08-11-2010 22:54 I would imagine most complaints about the channels come from other channels either as part of a rating issue, just to get 1 up or to destabalise a team. As Aston said nobody watches a programme going out in the early hours of the morning called babestation/televisionx/ red hot etc etc thinking it is good clean family entertainment so it is quite obvious where the complaints come from. I seem to remember 1 of the girls one time said in chatbox that the channel she was working for employed someone to watch the other channels and look for slips/mic left on etc ...ANYTHING that could generate a complaint RE: Serious warning for Elite TV - gazfc - 08-11-2010 23:23 If that's true marko that's scandalous, who if their right mind would think doing that would benefit them in the long run. Let's not kid ourselves that it does not happen on the babe channels, it happens in all industries. Formula 1 teams are quick to seek a stewards inquiry if they feel another team are breaching technology restraints, airlines get reported for price fixing certain routes etc etc... There is big money in porn so if the regulator is harrassing/penalising your opponents then you can quietly get on with your own show. Everyone has to play within the rules, it's just that Ofcom cannot give clear objective guidance to allow this nor accept the channels for what they are. It would be exactly the same if the rules were relaxed to allow frontal nudity the complaints would still be about the explicit nature of the broadcast.
