I believe they took the risk based on fooling people into signing up for a 12 month subscription based on what they saw in that freeview. Knowing very well it would only be a matter of time before they would have to change the content. Of course that is just my opinion. Occasionally a channel pushes the boundaries, gets fined, says it was an accident, and scoops up the £ from the rush of new subscribers ? OfCom noted that "the licensee of some size with considerable turnover and qualifying revenue", which suggests that the fines are a drop in the ocean, and OfCom know it. If OfCom wanted to hurt a channel they would close it, or suspend it for a month. Sadly taking OfCom to court won't benefit any broadcaster, because it will take several years to get a judgement, then all the other channels will benefit for free. Breaking the rules means one broadcaster gets all the publicity for the cost of a few newspaper adverts.
