I don't think this is just about Freeview rules. What about the Sexcetera program shown regularly on Freeview channel 20 (Virgin1). Smile TV presumably want you to pay to see the girls nude by downloading the pics that they keep advertising.

it is going on the 8 th of april as that is when the license expires and there are no signs of a renewal

As Gaz said, the licence runs out on the 8th April and there's nothing on ofcom's site about it being extended or renewed. Knowing Ofcom, if anything was happening with the licence at the mo, would be on their site by now.
