Thanks for the licence info Vostok, but all that means is that a channel might not be paying the correct fee. Having the wrong type of licence doesn't magiclly make the content obscene or OK. It doesn't magically cause children to be harmed.

If that's OfCom's argument a drunk paraplegic 90 year old lawyer would be able to humilate them in front of any judge.

I had a quick scan of the babe and porn channel licences on the Ofcom site and there's another grade of licence as well - adult editorial. This seems to be used primarily by the encrypted porn channels such as Adult, Amateur Babes, Blue Tube, Climax etc, although a small number of FTA babe channels also have this licence, such as Essex Babes and Live XXX Babes. I note however that David Wainright's other licences, Friendly TV (907) and Bedroom TV (962), both have general entertainment licences. I guess he makes money renting them out to other babe channel broadcasters. Both are now rented out to Bang Babes.

So where does this leave Chatback? And does having a teleshopping licence mean that they come under a different set of guidelines to the general entertainment channels?

Edit: I just checked Hotel Voyeur's licence (Over 18 TV) and they have something which looks unique - an adult chat/teleshopping licence! Perhaps that's an option for Chatback.

The teleshopping thing has been mentioned on several occasions by myself and others. Either 960 is operating legally or it isnt but before anyone gets any wrong ideas I haven't bothered contacting Ofcom because I couldn't care less any more. I get no signal from 960.. get perfect picture on 962 which is now Bang Babes. Maybe 960 is using a cheap satellite as well as a cheap licence!!!

A TV channel licensed as teleshopping has to comply with the broadcast advertising code, which doesn't allow adult content.

On the other hand, if a channel's output is licensed as editorial it is exempt from the advertising code, since the license defines the content as editorial and not advertising.

They've put Jessica back on now! Just goes to show the idiots at chatback are the complete package that everyone knows they are. Proving to Ofcom that the channels not aimed at adults!

Never heard about that.

Not surprisingly there is no mention of this on the OFCOM site. (I guess they wouldn't want to publicise that they were beaten in court!)

Had a search but I can't find anything on the court case.
