Having the wrong type of licence doesn't magiclly make the content obscene or OK. It doesn't magically cause children to be harmed. If that's OfCom's argument a drunk paraplegic 90 year old lawyer would be able to humilate them in front of any judge. On the other hand, if a channel's output is licensed as editorial it is exempt from the advertising code, since the license defines the content as editorial and not advertising.
