If only it was that simple. They usually wait for a complaint, but have been upfront about asking all babe channels for recordings in the past, and have taken action without recieving a single complaint.
Unlike the laws on public decency, not actually offending anyone doesn't count for anything on TV. They carried out a "survey" 5 years ago. Under 200 people were asked their opinion. The result is that opinion of 37 Asian women and 24 Afro-Caribbean women carries more weight than all the readers of this forum put together. I have nothing against Asians or Afro-Caribbeans, but if you deliberately conduct a poll among groups of people well known for strong religious beliefs the result is pretty predictable. And unrepresentative.

In which case the channel would be free to challenge/appeal any ruling and ultimately take the matter to court which is a similar way to the one in which hardcore porn became legally available certified r18 in britain. One company challenged a set of certifications and they were successful.
