Ofcom does routinely monitor broadcasts, they don't hide the fact though. If there is an adjudication it will mention that it arose from "routine monitoring", if that was the case.

The trade organisation that represents several of the channels had this to say on the issue of complaints:

"There seems no justification for this regulation on the basis of causation of harm or offence or the receipt of consumer complaints. We believe that all of the only 40 or so complaints received by OFCOM in the last 5 years have been made anonymously by industry competitors, a fact that is known to OFCOM."

as far as i know the business can be registered anywhere but i think they have to apply to ofcom (and the bbc for a feeview license) to broadcast into the uk, thus are bound by the ofcom license agreement. i guess if that wasn't the case all the channels would be registered offshore and give stronger content.
but hey what i think is the case, may well not be, as im not a lawyer.

I'm not sure about the Freeview licensing issues....

However, take this as an example of Ofcom/Sky Digital:

"Revelation" (Sky channel 581) has previously got into trouble with Ofcom, another investigation had begun, so they ditched their UK broadcast licence in April and registered their company in Spain.

They can still legally broadcast on Sky, yet they no longer have to comply with UK broadcasting regulations and Ofcom will not accept any further complaints about the channel.

So like Babestation on Sky, by registering your channel in Europe you can avoid UK censorship and broadcasting regulations, show whatever you want, plus you get to wear an Ofcom bullet proof vest.

Cellcast have 4 Dutch adult licences on freeview , with just Partyland registered in GB, when OFCOM were doing some sort of review about adult phone show on freeview Ofcom stated themselves that any new regulations brought in would not affect the 4 Cellcast shows as the were registered in Holland and they have no jurisdiction over them , also when BLUEBIRD OFFICIAL was answering questions about their shows standing up to OFCOM and showing more than other shows do he said "for legal reasons we can't go into deatails but OFCOM's powers are limited by the territoriality of the licence holder ... PS not sure if Cellcast have 3 or 4 Dutch licences , but it is one or the other .

Partyland (Cellcast channel) is licensed in the uk, whereas the other cellcast channels are registered in Holland. Bang Media should follow suit while there is still a loophole, unless they are happy to pay the fines. BS are allowed to show stronger content but are still one of the tamest shows around. Bluebird have a similar setup, so it will be interesting to see the strength of the free to air channels on Sky & Freeview.

edit: seems odd that BS scrapped BS2 and kept PL.

Babestation may be registered in Holland, but they obviously still abide by Offcom's regulations. Do we see full frontal on Babestation? Didn't think so.

I can understand Offcom not wanting to allow hardcore porn, but what harm will full frontal cause? It's a human body, not something disgusting.

Elite has been very strict lately on showing any glimpses of vajayjay, especially when Caty Cole is on. When there is going to be a quick glimpse, the cameraman does a super pan, like he's about to fall over, and the camera goes all crazy like a glimpse of a vagina is the apocalypse

What's also a bit silly is that these channels allow the women to simulate masturbation, oral sex, getting ejaculated on, having sex, fingering and licking their fingers, tongue kissing, nipple sucking, ass spanking, but under NO circumstances can you show your hoohoo Rolleyes
